Introduction:
These Terms of Service (the “Agreement”) form an agreement between you (the “User”) and Howitzer Games, LLC (the “Provider”) regarding digital entertainment media, software, games, applications, and other digital content (collectively, the “Content”) provided by Howitzer Games through third-party platforms and services, including but not limited to the Apple App Store, Google Play Store, and Microsoft Store (collectively, the “Services”).
By accessing, downloading, installing, purchasing, or using Content provided by Howitzer Games, you agree to this Agreement and to the applicable terms, conditions, policies, and requirements of the Service through which the Content is provided.
Use of Content:
The User agrees to use the Content only in accordance with this Agreement, the applicable terms and policies of the Service through which the Content is provided, and all applicable laws and regulations.
The Content is provided for personal, non-commercial use unless otherwise authorized by the Provider.
The User may not use the Content in any manner that violates applicable law, the terms of the applicable Service, or the intended use of the Content.
The Provider reserves the right, subject to applicable law and the policies of the applicable Service, to restrict or terminate access to Content when necessary due to misuse, violation of these terms, violation of applicable Service policies, or other circumstances affecting the operation or security of the Content.
Content Management:
The Provider makes reasonable efforts to maintain and provide Content and associated features in a reliable and functional manner. However, the Provider does not guarantee that Content, features, progress, purchases, or other Content-related information will always be available, accurate, uninterrupted, or free from errors.
Content-related information, including progress, purchases, account information, or other data associated with the use of Content, may be affected by device failures, application updates, Service updates, technical issues, or other circumstances outside the Provider’s reasonable control.
The User acknowledges that the Provider cannot guarantee the preservation or recovery of Content-related information in every circumstance and agrees to hold the Provider harmless of any damages caused by using the content.
User Information:
The Provider’s collection and use of information is described in the Provider’s Privacy Policy.
The Provider may also rely on third-party Services, platforms, and service providers to provide, operate, maintain, analyze, distribute, or support the Content. Information handled by those Services may be subject to their respective terms and privacy policies.
Changes to this Agreement:
The Provider may modify this Agreement from time to time.
The Provider will provide reasonable notice of material changes when required by applicable law or the applicable Service.
Continued use of Content after the effective date of a change constitutes acceptance of the revised Agreement, to the extent permitted by applicable law.
Purchases:
Content may be available for free download, offered for purchase, or provided through a combination of free and paid features, including optional in-app purchases.
In-app purchases may provide digital items, features, content, or other benefits associated with the applicable Content. In-app purchases are optional unless otherwise stated.
All purchases are processed through the applicable Service, such as the Apple App Store, Google Play Store, or Microsoft Store. Howitzer Games does not directly process payments for purchases made through these Services.
Refunds and other purchase-related matters are subject to the terms and policies of the Service through which the purchase was made. Users may contact Howitzer Games for assistance with a purchase, but the applicable Service’s terms and refund policies will govern the purchase and refund process.
The Provider makes reasonable efforts to ensure that purchased Content is properly delivered. However, purchased Content or Content-related information may be affected by device issues, application updates, Service-related issues, or other circumstances outside the Provider’s reasonable control.
Legal:
This Agreement does not limit or invalidate any rights or protections provided to the User under applicable federal, state, local, or other applicable laws.
If any provision of this Agreement conflicts with applicable law or the applicable terms of a Service, the applicable law or Service terms will prevail to the extent of the conflict.
If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by applicable law.

Howitzer Games, LLC
Organized and operating under the laws of the State of Maryland State, USA.
Additional Terms:
In addition to this Agreement, the User may be subject to the terms, conditions, policies, and other requirements of the Service through which Content is accessed or purchased.
