Introduction:
These terms form an agreement (the Agreement) between you (the User) and Howitzer Games, LLC (the Provider) for digital entertainment media (the Content) offered through various company services such as Google Play Store, Apple Store, and Microsoft Store (the Services). As a User of this Content through these services, you agree to the following terms in addition to the Terms of Service and associated policies (TOS) provided by the Services. See the bottom of this agreement for references to the TOS provided by the Services.
Use of Content:
The User agrees to only use the Content created and owned by the Provider in accordance with this Agreement and the TOS provided by the Services. Any inappropriate use of this Content may result in removal of the User from being able to use any Content created and owned by the Provider.
Content Management:
The Provider makes every attempt to provide a perfect Content experience where Content progress information, in-app purchases, and Content purchases (Content Information) execute perfectly. The Services attempt to provide a backup means of Content Information, however, Content Information is still at risk of being lost with the Users mobile device, through updates supporting the Content and the Services. The User agrees to hold the Provider harmless of any damages resulting from loss of Content such as in-app purchases.
User Information:
The Provider does not collect, gather, use or sell any information about the User. Refer to the Providers Privacy Policy for more information.
Changes to this TOS:
The Provider will notify the User 60 days prior to the effective date of any changes to this Agreement. Current use of any Content offered through the Service by the Provider is considered consent to this existing agreement and continued use of the Content following notice of a change to this Agreement is considered consent to the changes and the new Agreement.
Purchases:
The Providers Content may be for sale or may be offered for download for free with in-app purchases through the Services.
For sale Content provided through the Services will be subject to the same TOS, associated policies including refund policies provided by the Services. Users may contact the Provider to request a refund but the Service’s policies will prevail associated with all sales of Content offered by the Provider through the Services.
For free Content with in-app purchases provided through the Services will be subject to the same TOS and associated policies including refund policies provided by the Services. Sales of in-app purchases which are consumable in nature are assumed to be consumed immediately upon purchase into the User’s downloaded version of the Content. ALL SALES OF IN-APP PURCHASES ARE SOLD AS IS AND ARE NOT REFUNDABLE. Users may contact the Provider to request a refund however there is no method for the Provider to verify whether or not a consumable in-app purchase has or will be consumed before or during a standard refund process. The Provider strives to provide the best experience possible associated with in-app consumable purchases, however, in the event the in-app purchase does not provide the Users perceived outcome within the Content, the User agrees to hold the Provider harmless for any damages real or perceived. In addition, the User agrees to hold the Provider harmless for any damages resulting from unintended purchases even if the purchase or consumption of an in-app purchase is by accident by another friend or family member or other unauthorized third party with access to the device containing the Content.
Legal:
This Agreement does not invalidate the Users individual rights and protections under Federal, State, and local laws. Any instance where the terms in this Agreement conflict with the TOS provided by the Services, the Services’ TOS shall prevail. Any failure of any part of this Agreement where another TOS or law prevails does not invalidate any other remaining parts of this Agreement.
